Approval of the petition by Aaron Petersen to vacate the portion of a public drainage and utility easement located on the property at 2318 Indigo Drive, Clearwater, Florida 33763.

 

                     Request is for the vacation of a portion of a platted easement that is located on the petitioner’s property.

                     The applicant is requesting to vacate that portion of the 6-foot Drainage and Utility Easement in order to resolve existing encroachments.

                     Staff recommends approval.

                     If the petition is granted, the Board of County Commissioners is asked to adopt the attached Resolution pursuant to Florida State Statute §177.101.

 

Authorize the Clerk of the Circuit Court to record the resolution in the public records of Pinellas County.

This request is to vacate that portion of the 6-foot Drainage and Utility Easement that is located in the petitioner’s side yard. The easement was established as part of the Plat. The petitioner is seeking to resolve existing encroachments. There are no county utilities located or proposed to be located in the easement.

Background Information:

County staff reviewed the request pursuant to Pinellas County Land Development Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request.

The petition was properly advertised in accordance with Florida State Statute 177.101. Notices were mailed by the Clerk of the Court to property owners within 250 feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.

Letters of no objection were received from Duke Energy, TECO Gas, TECO Electric, Frontier, Charter/Spectrum and WOW!.
