Approval and execution by the County Administrator of the Second Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (Agreement) with Community Action Stops Abuse, Inc. (CASA), for CDBG funded facility improvements.
• This Second Amendment extends the term of Agreement CD23CASA six (6) months to June 30, 2025. Additional time for project completion is necessary due to permitting and contractor delays.
• This Second Amendment also extends the term of the Restricted Period six (6) months to July 1, 2033, restricting the use of the property to serving as an emergency shelter for survivors of domestic violence and their children.
• The funding amount, not to exceed $100,000.00 during the term of the Agreement, remains unchanged.
• On December 12, 2023, the County Administrator executed Agreement CD23CASA providing CDBG funding to CASA for costs associated with facility rehabilitation including improvements to two (2) kitchens at CASA’s Domestic Violence Emergency Shelter, benefitting approximately 500 survivors of domestic violence and their children. The address of the shelter is confidential per Florida Statute 39.908.
• On August 14, 2024, the First Amendment to Agreement CD23CASA extended the term of the Agreement three (3) months to December 31, 2024, and extended the term of the Restricted Period three (3) months to January 1, 2033.
• Funding for this Agreement is included in the County’s Fiscal Year 2025 (FY25) Adopted Budget for CDBG funds within Housing and Community Development (HCD).Body

Summary:
This Second Amendment to CDBG Program Subaward Specific Performance and Land Use Agreement CD23CASA extends the term of the Agreement six (6) months to allow for project completion and extends the term of the Restricted Period.
The Agreement requires that performance be completed by December 31, 2024. Due to delays in the permitting process and the emergency health issues of the contractor, CASA is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement six (6) months to June 30, 2025, as additional time is required for the completion of the project. As a result of the term extension, it is necessary to extend the term of the Restricted Period six (6) months to July 1, 2033, restricting the use of the property to serving as an emergency shelter for survivors of domestic violence and their children.
Background/Explanation:
At the July 18, 2023, Board of County Commissioners (Board) meeting, the Board approved agenda item #66 (Granicus #23-1011A), Resolution 23-56 approving the Fiscal Year 2024 (FY24) Annual Action Plan. Included as an attachment in the approved Action Plan is the FY24 Funding Recommendations table, which identifies each specific project, subrecipient, and funding award amount. The CASA Facility Rehabilitation Project was approved as a facility rehabilitation activity in the Action Plan.

Authority for the County Administrator to sign this Amendment is granted under (Code Section 2-62 (a)(1) and Resolution No. 23-56.
