Approval and execution by the County Administrator of the Second Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (Second Amendment) with Society of St. Vincent de Paul South Pinellas, Inc. d/b/a St. Vincent de Paul CARES (SVdP), for a CDBG funded facility rehabilitation.

 

                     This Second Amendment to Agreement CD22SVdP amends the legal description to remove adjacent parcels owned by SVdP that are not receiving CDBG funding but were inadvertently included in the original agreement and therefore subject to the use restriction. SVdP intends to construct a 73-unit affordable housing apartment complex on the adjacent parcels. The restriction will remain in place for the parcel of land containing the CDBG-funded renovated building.

                     This Second Amendment provides an additional $83,620.46 in CDBG funding to cover the cost of the bids that came in higher than the original allocated amount for the project.

                     This Second Amendment extends the term of the Restricted Period 48 months to July 1, 2040, restricting the use of the property to serving homeless individuals.

                     This Second Amendment increases the amount of required property insurance, to an amount equal to total project construction costs.

                     The increase to this agreement is consistent with the fiscal year 2023/2024 (FY24) Adopted Budget for CDBG funds and is not to exceed $267,785.46, during the term of the Agreement.

                     On September 20, 2022, the County provided funding to SVdP for costs associated with facility improvements including the renovation of bathrooms and corridors at the SVdP CARE Center night shelter, located at 401-15th Street North, St. Petersburg, FL 33705, benefitting approximately 25,000 homeless individuals.

                     On July 17, 2023, the First Amendment extended the term of Agreement CD22SVdP nine (9) months to June 30, 2024, to provide additional time for plan review, permitting, procurement of services, and for the completion of the project and extended the term of the Restricted Period nine (9) months to July 1, 2036, restricting the use of the property to serving homeless individuals.

Summary:

This Second Amendment to Agreement CD22SVdP removes adjacent parcels owned by the agency that were inadvertently identified and encumbered by the use restrictions included for the parcel of land consisting of the CDBG-funded renovated building. SVdP intends to construct a 73-unit affordable housing apartment complex on the adjacent parcels. The land consisting of the CDBG-funded renovated building remains restricted.

This Second Amendment provides an additional $83,620.46 in CDBG funding to cover the cost of the bids that came in higher than the original allocated amount for the project. The increase to this agreement is consistent with the FY24 Adopted Budget for CDBG funds.

As a result of the funding increase, the amount of required property insurance will increase to an amount equal to total project construction costs and it will be necessary to extend the term of the Restricted Period 48 months to July 1, 2040, restricting the use of the property to serving homeless individuals.

 

Background/Explanation:

On July 19, 2022, the Board executed Resolution No. 22-60, which approved the 2022-2023 (FY23) Action Plan. The SVdP Facility Rehabilitation Project was approved as a facility rehabilitation activity in the Action Plan.

On September 20, 2022, the County Administrator executed CDBG Agreement CD22SVdP, providing CDBG funding for facility improvements including the renovation of bathrooms and corridors at the SVdP CARE Center night shelter, located at 401-15th Street North, St. Petersburg, FL 33705, benefitting approximately 25,000 homeless individuals. The Agreement was effective October 1, 2022 through September 30, 2023, with the land use restriction expiring on October 1, 2035.

On July 17, 2023, the First Amendment extended the term of Agreement CD22SVdP nine (9) months to June 30, 2024, to provide additional time for plan review, permitting and procurement of services, for the completion of the project and extended the term of the Restricted Period nine (9) months to July 1, 2036, restricting the use of the property to serving homeless individuals.

 

Fiscal Impact:

The total amount of funding for this agreement is not to exceed $267,785.46 during the term of the Agreement. Funding for this Agreement is consistent with the County’s FY24 Adopted Budget for CDBG funds.

 

Delegated Authority:

Authority for the Board Chair to sign this Agreement is granted under Resolution No. 22-60.
