Approval and execution by the County Administrator of Change Order No. 1 with Cone and Graham, Inc. for design build services pertaining to the Pinellas Trail Loop North Segment - Shared Use Non-Motorized Trail Program.
• Approval of this contract was for the purpose of designing and constructing a 6.7 mile “North Gap” of the Pinellas Trail extending from John Chesnut Park in Palm Harbor to Enterprise Road in Clearwater, utilizing sections of the Duke Energy right-of-way to complete the trail corridor.
• Change Order No. 1 decreases the contract by $1,898,184.17 and removes bridge construction over Lake Tarpon Outfall Canal (LTOC) and the Pinellas Trail approaches to the bridge.
• The bridge construction is being removed due to the County was required to obtain an easement by December 15, 2020, to construct the bridge, otherwise a 10% price escalation would be imposed per the contract; the easement was not acquired until September 17, 2021, and original pricing could no longer be held to construct the bridge.
• Phase One design was approved by the Board of County Commissioners (Board) on March 20, 2018, in the amount of $1,599,461.80. Work included sixty percent (60%) construction documents, guaranteed maximum price (GMP), final plans completion and permitting.
• Phase Two construction was approved by the Board on April 7, 2020, via Amendment No. 1, with a GMP award amount of $9,347,046.69, not including contingency.
• Funding is provided in part by a Florida Department of Transportation (FDOT) grant in the amount of $6,200,000.00 and the remaining County portion is derived from the Local Infrastructure Sales Tax (Penny for Pinellas): Pinellas Trail Projects, Pinellas Trail North Segment - PID No. 000967A.
Contract No.167-0071-NC (SS); reduction in the amount of ($1,898,184.17) for a revised project total for both phases in the amount of $10,348,324.32. Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary
Change Order No. 1 decreases the agreement amount by $1,898,184,17 and removes construction of the bridge component, allowing the County to advertise the bridge as a separate construction project later this summer under Project ID No. 000967C. Staff recommends the County opt not to construct the bridge as part of the Design Build contract due to the increase in costs. In addition to the ten percent (10%) escalation clause, which amounted to approximately to $180,000.00, the contractor requested approximately $600,000.00 in additional funds for bridge construction which increased the price of the bridge by approximately $780,000.00 over the original cost.
FDOT has provided its approval for this Change Order. The expiration date of the FDOT grant Agreement is December 31, 2022.

Background Information:
Cone and Graham, Inc. completed Phase One (60% design) on February 5, 2020, at a cost of $1,599,610.80, submitting GMP and Final Plans design construction documents. Actual Phase Two (construction) commenced on June 1, 2020. The anticipated completion date for Phase Two (construction) is July 21, 2022, will the exception of the bridge.
As part of the Phase Two GMP construction price, an easement was required in an area of Zone B through the IMT Boot Ranch property to construct the Trail. Until this easement was obtained by the County, construction of the Trail from the north side of Tampa Road (to the northern limit of Zone B (Sta. 1294+15.93) was included in the contract as an optional service. This area includes the bridge over the Lake Tarpon Outfall Canal. The price included in the GMP for the bridge pay items is a subcontractor price. The subcontractor held current pricing until December 15, 2020. As the option to construct this section of the Trail was not exercised by December 15, 2020, there is a 10% escalation in the bridge items by the subcontractor. This optional bridge and trail approaches construction can be removed from this contract at any time at the sole discretion of the County.
Fiscal Impact:
The project is partially funded by FDOT as part of a $6,200,000.00 Florida SUN Trail grant. The County is funding the remaining amount of $4,148,324,32. The funding source for the County’s portion is derived from the Local Infrastructure Sales Tax (Penny for Pinellas III): Pinellas Trail Projects, Pinellas Trail North Segment - PID No. 000967A, and Local Infrastructure Sales Tax (Penny for Pinellas IV): Pinellas Trail Projects, Trail Projects PID No., 003682A. The current project budget will need to be revised during the Fiscal Year (FY) 2023 Annual Budget process to revise grant funds and reallocate funds for the bridge construction.
