Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (First Amendment) with Friends of Ridgecrest, Inc. for CDBG funded property acquisition.
• This First Amendment provides an additional $33,596.00 in CDBG funding, for a total CDBG investment of $143,596.00, to cover the costs associated with the design, engineering and permitting for the next phase of the construction of a parking lot at the Tasker Beal, Jr. Service Center.
• This First Amendment also extends the term of Agreement CD21FOR six (6) months to March 31, 2025, to provide additional time for project completion, and extends the term of the Restricted Period one (1) year and six (6) months to April 1, 2035, restricting the use of the property to serving low- and moderate-income individuals within the Greater Ridgecrest Area.
• This First Amendment additionally increases the amount of required property insurance, to an amount equal to total project construction costs.
• On June 2, 2023, the County provided CDBG funding to Friends of Ridgecrest for costs associated with the acquisition of property; demolition and clearance of an existing structure; and site work, design, engineering and permitting necessary for the construction of a parking lot, located at 1598 Gooden Xing, Seminole, FL 33778, within the Greater Ridgecrest Area, a locally designated low- and moderate-income target area. The Agreement was effective May 1, 2023, through September 30, 2024, with the land use restriction expiring on October 1, 2032.
• Funding for this amendment is included in the current-year budget of the Housing and Community Development Department in the Community Development Grant Fund.

Summary:
This First Amendment to Agreement CD21FOR provides additional CDBG funding; extends the term of the Agreement; extends the term of the restricted period; and increases the amount of required property insurance coverage FOR must carry through the term of the Agreement.
The first phase of the construction project included the acquisition of property; demolition and clearance of an existing structure; and site work. This First Amendment provides an additional $33,596.00 in CDBG funding, for a total CDBG investment of $143,596.00, to cover the costs associated with the design, engineering and permitting for the next phase of the construction of a parking lot at the Tasker Beal, Jr. Service Center.
The Agreement requires that performance be completed by September 30, 2024. Friends of Ridgecrest is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement six (6) months to March 31, 2025, as additional time is required for the completion of the next phase of the project.
As a result of the term extension, it is necessary to extend the term of the Restricted Period one (1) year and six (6) months to April 1, 2035, restricting the use of the property to serving low- and moderate-income individuals within the Greater Ridgecrest Area.
As a result of the additional funding being provided, it is necessary to increase the amount of property insurance Friends of Ridgecrest must carry on the property to equal the amount of the CDBG funded construction costs.
Background/Explanation:
On July 13, 2021, the Board executed Resolution No. 21-47, which approved the 2021-2022 (FY22) Action Plan. The Friends of Ridgecrest Acquisition Project was approved as a facility rehabilitation activity in the Action Plan.
On June 2, 2023, the County provided CDBG funding to Friends of Ridgecrest for costs associated with the acquisition of property; demolition and clearance of an existing structure; and site work, design, engineering and permitting necessary for the construction of a parking lot, located at 1598 Gooden Xing, Seminole, FL 33778, within the Greater Ridgecrest Area, a locally designated low- and moderate-income target area.
The Agreement was effective May 1, 2023, through September 30, 2024, with the land use restriction expiring on October 1, 2032.
Fiscal Impact:
The total amount of funding for this agreement is not to exceed $143,596.00 during the term of the Agreement. Funding for this agreement is included in the current-year budget of the Housing and Community Development Department in the Community Development Grant Fund.
Delegated Authority:
Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62 (a) (1) and Resolution No. 23-56.
