Approval of the petition by Charles and Rita King to vacate the 33-foot-wide portion of the Portsmouth Road right-of-way.

 

                     Request is for the vacation of a portion of an unimproved right of way that is behind the petitioner’s property located at 1725 Doncaster Road.

                     There is no public access to this portion of the right of way.

                     Staff recommends approval.

                     If the petition is granted, the Board of County Commissioners is asked to adopt the attached resolution pursuant to Florida State Statute 336.09.

 

Authorize the Clerk of the Circuit Court to record the resolution in the public records of Pinellas County.

Summary

The purpose of the request is to vacate a portion of a 33-foot-wide unimproved right-of-way known as Portsmouth Road, lying east of 1725 Doncaster Road, the petitioner’s property. This right of way was never constructed nor is there a future need. The applicant has no plans for the use of the petitioned area. Additionally, multiple adjacent property owners have also completed a roadway vacation of Portsmouth Road adjacent to their properties.

Background Information:

County staff reviewed the request pursuant to Pinellas County Land Development
Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request.

The petition was properly advertised in accordance with Florida State Statue 336.10. 

Notices were mailed by the Clerk of Court to property owners within 250 feet of the subject property.

Letters of no objection were received from Spectrum, Pinellas County Utilities, Frontier, TECO Gas, TECO Electric, Duke, and WOW!.
