Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant - Coronavirus Response (CDBG-CV) Program Subaward Specific Performance and Land Use Restriction Agreement (First Amendment) with the Safety Harbor Neighborhood Family Center, Inc. d/b/a Mattie Williams Neighborhood Family Center (Mattie Williams NFC), for CDBG-CV funded facility improvements.

 

                     This First Amendment extends the term of Agreement CDCV19MWEXP three (3) months to March 31, 2025, to provide additional time for project completion due to material shortages which delayed project commencement and extends the term of the Restricted Period three (3) months to April 1, 2045, restricting the use of the property to serving low-and moderate-income community residents.

                     The funding amount, not to exceed $717,182.83 during the term of the Agreement, remains unchanged.

                     On May 13, 2024, the Board Chair executed Agreement CDCV19MWEXP providing $717,182.83 in CDBG-CV funding for costs associated with the construction of a 1,400 square foot facility expansion to include an additional meeting area, food pantry space, office space, a kitchenette, bathrooms, and a storage area at the Mattie Williams NFC, located at 1003 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695, serving approximately 30,000 low-and moderate-income community residents.

                     The Agreement was effective January 1, 2024, through December 31, 2024, with the land use restriction expiring on January 1, 2045.

Summary:

This First Amendment to the CDBG-CV Program Subaward Specific Performance and Land Use Restriction Agreement CDCV19MWEXP extends the term of the Agreement three (3) months to allow for project completion and extends the term of the Restricted Period.

The Agreement requires that performance be completed by December 31, 2024. Due to material shortages which delayed commencement of the project, Mattie Williams NFC is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months to March 31, 2025, as additional time is required for project completion. As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months to April 1, 2045, restricting the use of the property to serving low- to moderate-income community residents.

 

Background/Explanation:

On July 23, 2019, in Resolution 19-48, the Board of County Commissioners (Board) approved the 2019-2020 Action Plan.

On July 21, 2020, in Resolution 20-68, the Board approved a Substantial Amendment to the Action Plan to include CDBG-CV funds and on April 27, 2021, in Resolution 21-24, the Board approved a Second Substantial Amendment to the Action Plan to include additional CDBG-CV funds in order to carry out eligible activities; and

On May 13, 2024, the Board Chair executed Agreement CDCV19MWEXP providing $717,182.83 in CDBG-CV funding for costs associated with the construction of a 1,400 square foot facility expansion to include an additional meeting area, food pantry space, office space, a kitchenette, bathrooms, and a storage area at the Mattie Williams NFC, located at 1003 Dr. Martin Luther King Street North, Safety Harbor, Florida 34695, serving approximately 30,000 low-and moderate-income community residents.

The City of Safety Harbor awarded the Mattie Williams NFC $450,000.00 of funding for this project. The County contributed $385,000.00 of CDBG funding to this project.

 

Fiscal Impact:

The total amount of funding for this agreement is not to exceed $717,182.83 during the term of the Agreement. Funding for this Agreement is included in the County’s FY25 Adopted Budget for CDBG funds within HCD.

 

Delegated Authority:

Authority for the County Administrator to sign this Amendment is granted under Resolutions 20-68, 21-24 and 24-46.
