Summary:

This ordinance will update and amend the adopted Ten Year Water Supply Facilities Plan, a.k.a. the Work Plan, of the Potable Water Supply, Wastewater & Reuse Element of the Pinellas County Comprehensive Plan. 

The previous Ten Year Water Supply Facilities Plan included capital programs that focused primarily on ensuring that infrastructure investments met growing wholesale and retail water supply needs. During this period of growth, the Utilities Department implemented CIP projects to address increasing operational and regulatory pressures on controlling supply and demand requirements on the regional and local water supply system.

With the stabilization of growth and focus on redevelopment in Pinellas County, the Utilities Department has shifted its focus from managing growth requirements towards the operation and maintenance of existing infrastructure to ensure a safe and sustainable water supply. The following specific Water Supply, Transmission and Distribution Projects are included in the Pinellas County 10 Year CIP and within the Capital Programs of this amended Work Plan:

Background Information:

The primary purpose of the Work Plan update is to meet water supply and water facilities planning statutory requirements, and to identify and plan for water supply sources and facilities needed to meet existing and projected retail and wholesale potable water demands within the County’s Water Demand Planning Area.

Specifically, Section 163.3177(6)(c), Florida Statutes (F.S.), requires local governments to adopt a work plan into their Comprehensive Plan within 18 months after the Southwest Florida Water Management District (SWFWMD) adopts, or updates, the Regional Water Supply Plan.  The most recently updated Regional Water Supply Plan was approved by SWFWMD in November 2015, and the deadline for local governments to meet this requirement is May 2017. 

Staff from the Utilities Department worked with the Planning Department to complete the required changes to the Work Plan, updating it to be consistent with the County’s Capital Improvement Program (CIP) adopted by the Pinellas County Board of County Commissioners on September 27, 2016. 

Staff has provided each municipality who is a retail or wholesale water customer with a copy of the updated Work Plan draft to assist them with preparing the necessary updates to their respective Comprehensive Plans, evidencing the County’s commitment to meeting wholesale and retail water needs.

On November 10, 2016, the LPA found the proposed Ordinance consistent with the Pinellas County Comprehensive Plan and voted unanimously to recommend the Ordinance be approved.

Subsequent to the LPA public hearing, the Board conducted a public hearing on the proposed Ordinance on December 13, 2016, at which time the Board authorized transmittal of the proposed amendments to the Florida DEO and other state and regional agencies for review and comment.  The comments from the review agencies are attached.  All responding agencies, with the exception of the Southwest Florida Water Management District (SWFWMD), found no adverse impacts to resources or facilities.

SWFWMD’s review letter offered five comments for consideration.  County Planning Department and Utilities Department staff held a conference call with SWFWMD staff to discuss the comments and address any questions or concerns.  As a result, a few minor clarifications and additions have been incorporated into the proposed Ordinance; and a memorandum from the County Utilities Department to the County Planning Department was prepared addressing the comments within the SWFWMD review letter.  The memorandum is included as an addendum to this staff report.

The minor changes made to the proposed Ordinance are noted with yellow highlighted text in the attached strike-through and underlined version.  The only substantive changes made, per recommendation by SWFWMD staff, include notation of the planning period date range for the water supply facilities work plan and the addition of two utility service area maps depicting potable water and waste water service areas.

 

Fiscal Impact:

No additional costs will be incurred by Pinellas County in the approval of the amended Work Plan.
