Recommended Action

Approval of the petition to vacate that portion of County Road 144, a petitioned road. Located parallel to 6160 Ulmerton Road, Clearwater, Florida.

 

                     The request is for the vacation of a 35-foot-wide portion of a right-of-way.

                     County staff has no objection to the vacation request, contingent upon the retention of Pinellas County utility easement over the entire vacated area.

                     Petitioners request would support the historical use of the existing parking area on the adjacent commercial parcel.

                     The City of Largo, TECO Peoples Gas System, Inc., and Pinellas County Utilities granted letters of no objection with conditions that an easement agreement over the petitioned area would be provided for each utility provider.

                     If the petition is granted, the Board of County Commissioners is asked to adopt the attached Resolution pursuant to Florida State Statue 336.09.

                     Notices were mailed to property owners within 250 feet of the petitioned area. No correspondence has been received.

 

Authorize the Clerk of the Circuit Court to record the resolution and the Pinellas County Utilities easement in the public records of Pinellas County.

Summary:

The purpose of the request is to vacate a 35-foot-wide right-of-way lying partially within a 100-foot-wide petitioned road and that has historically served as the parking area for the Time Square Plaza. The property owner has agreed that if vacated they would provide the requested utility easements to Pinellas County, City of Largo and People’s Gas.

 

Background Information:

County staff reviewed the request pursuant to Pinellas County Land Development Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request subject to easements being granted over the vacation area.

The petition was properly advertised in accordance with Florida State Statute 336.10. Notices were mailed by the Clerk of the Court to property owners within 250 feet of the subject property. A sign was posted on the site. The Deputy Clerk will report to the Board any citizen support or opposition.

Letters of no objection were received from Spectrum, Pinellas County Utilities, City of Largo, Frontier, TECO Peoples Gas System, Inc, Duke and WOW.

The City of Largo, TECO Peoples Gas System, Inc, and Pinellas County Utilities granted these letters of no objection with conditions that an easement agreement over the petitioned area would be provided.

 

Fiscal Impact:

$750.00 has been received as a Petition Fee from the Petitioners for this request.
