Approval of the petition to vacate a portion of a 20-foot drainage easement located on the property at 3170 Honeysuckle Road.

 

                     Request is for the vacation of a portion of the 20-foot drainage easement.

                     The petitioners are requesting the vacation to allow for redevelopment of the property with a new home.

                     Staff recommends approval.

                     If petition is granted, Board of County Commissioners is asked to adopt the attached Resolution pursuant to Florida State Statue 177.101.

 

Authorize the Clerk of the Circuit Court to record the resolution in the public records of Pinellas County.

Summary:

The purpose of the request is to vacate a triangle shaped upland portion of a 20-foot drainage easement located in the backyard of the petitioner’s property. The petitioners are proposing to redevelop the property with a new home. The vacation is needed to accommodate the new structures. The county requested and received from the petitioners a separate drainage easement on the south end of their property, which better aligns with county’s needs for drainage in this area.  

 

Background Information:

County staff reviewed the request pursuant to Pinellas County Land Development Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request. The petitioner has granted a needed easement in response to the review completed by staff.

The petition was properly advertised in accordance with Florida State Statute 177.101. Notices were mailed by the Clerk of the Court to property owners within 250 feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.

Letters of no objection were received from Spectrum, Pinellas County Utilities, Frontier, TECO Gas, Teco Electric, Duke and WOW!.

 

Fiscal Impact:

$750.00 has been received as a Petition Fee from the Petitioners for this request.
