Summary:

Approval and execution of this ILA with the City will establish revenue sharing terms and outline duties and responsibilities of each party.

Background/Explanation:

The County and City have had an ILA in place since April 6th, 2010, outlining terms for the City’s use of the Premises.  The County also has a separate Concession Contract (CC) with Sand Dunes Beach Services for operation of the concession and restrooms located on the Premises, which contract expires on June 20, 2023.

This new ILA continues the terms related to the Premises and also grants the City the authority to oversee the concession services and enter into their own contract to effectuate the same; the current CC will terminate upon execution of this new ILA.  The County will not be a party to the new concession contract, and the City will retain any and all revenue generated from operation of the concession. In return, the City agrees to assume the janitorial responsibilities of the public restrooms located on the Premises.

Fiscal Impact:

There is no set dollar amount listed in the agreement. However, per the agreement (Attachment 1, Section 3), gross parking fees revenues (less applicable State Sales Tax) shall be shared evenly between the City of St. Pete Beach and Pinellas County.  City of St Pete Beach agrees to remit to COUNTY its share of said gross receipts on a quarterly basis along with a  quarterly report indicating gross receipt totals, less applicable sales tax total, and final split amounts.

Anticipated revenues have been included in PCR’s FY23 Budget ($682,100) and FY24 Budget ($760,000), a $77,900, or 11.4% , over the FY23 Budget. No negative budgetary impacts are anticipated.

Delegated Authority:

Authority for the County Administrator to approve and sign this ILA is granted under Code Section 2-62(a)(5).
