First Amendment to the Specific Performance Agreement and Land Use Restriction Agreement with The Arc Tampa Bay, Inc. for Community Development Block Grant funded facility improvements.
Recommended Action:
Approval and execution by the County Administrator of the First Amendment to the Specific Performance Agreement and Land Use Restriction Agreement (Agreement) with The Arc Tampa Bay, Inc. for facility improvements.
• The Agreement provides $95,500.00 of Community Development Block Grant funds for the installation of a photovoltaic energy system at The Arc Tampa Bay’s Tarpon Springs Day Program facility.
• The Arc Tampa Bay provides services to approximately 24 individuals with intellectual and/or developmental disabilities at the Tarpon Springs Day Program facility located in a County designated target area.
• The amendment revises the scope of the project description to include roof replacement in addition to the new solar energy system.
• No additional funding is required. Solar system costs are below the originally estimated amount.

Summary:
The First Amendment to the Specific Performance and Land Use Restriction Agreement will amend the project description to add the replacement of the roof at the facility. The existing roof at the facility is 18 years old. The useful life of the proposed solar energy system is projected to be 20 years. The existing roof, which will not last for the projected useful life of the solar energy system, needs to be replaced before the solar energy system is installed.
The amount of funding and the original completion date of September 30, 2019 will not be impacted by the First Amendment.
Background/Explanation:
On June 19, 2018, the Board executed Resolution 18-35, which approved the 2018-2019 Action Plan. One of the projects to be carried out under the County’s 2018-2019 Action Plan is The Arc Tampa Bay Tarpon Springs Day Program Facility Rehabilitation Project, benefitting residents in a County designated target area.
On October 10, 2018, the County Administrator executed SPA CD18ARCTS, effective October 1, 2018 through September 30, 2019.
Fiscal Impact:
There is no fiscal impact for this amended Agreement. The total amount of funding for this project is not to exceed $95,500.00 during the term of the Agreement. Funding for this Agreement is budgeted from FY19 CDBG funds.
