Approval and execution by the County Administrator of the Third Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (Third Amendment) with Society of St. Vincent de Paul South Pinellas, Inc. d/b/a St. Vincent de Paul CARES (SVdP), for a CDBG funded facility rehabilitation.

                     This Third Amendment to Agreement CD22SVdP revises the property description to correct the inaccurate legal description depicted in the Second Amendment for the SVdP parcel located at located at 401-15th Street North, St. Petersburg, FL 33705. The corrected legal description will accurately be represented as, The West 135 feet of Lot 1, Block 1, DOCTOR'S PARTIAL RE PLAT, according to Plat thereof as recorded in Plat Book 73, Page 43, of the Public Records of Pinellas County, Florida.

 

                     This Third Amendment does not affect the existing funding amount or the terms of the specific performance period or restricted period of the Agreement. They remain unchanged.

 

                     On September 20, 2022, the County provided funding to SVdP for costs associated with facility improvements including the renovation of bathrooms and corridors at the SVdP CARE Center night shelter, located at 401-15th Street North, St. Petersburg, FL 33705, benefitting approximately 25,000 homeless individuals.

 

                     On July 17, 2023, the First Amendment extended the term of Agreement CD22SVdP nine (9) months to June 30, 2024, to provide additional time for plan review, permitting, procurement of services, and for the completion of the project and extended the term of the Restricted Period nine (9) months to July 1, 2036, restricting the use of the property to serving homeless individuals.

 

                     On December 6, 2023, the Second Amendment amended the legal description to remove adjacent parcels owned by SVdP that were not receiving CDBG funding but were inadvertently included in the original agreement and therefore subject to the use restriction. The Amendment also provided an additional $83,620.46 in CDBG funding to cover the cost of the bids that came in higher than the original allocated amount for the project, thereby increasing the total CDBG investment to $267,785.46. Additionally, it extended the term of the Restricted Period 48 months to July 1, 2040, restricting the use of the property to serving homeless individuals and increased the amount of required property insurance, to an amount equal to total project construction costs.

                     Funding for this amendment is consistent with the FY24 Adopted Budget, within the Housing and Community Department’s CDBG Fund.

Summary:

Background/Explanation:

On July 19, 2022, the Board executed Resolution No. 22-60, which approved the 2022-2023 (FY23) Action Plan. The St. Vincent de Paul Facility Rehabilitation Project was approved as a facility rehabilitation activity in the Action Plan.

On September 20, 2022, the County Administrator executed CDBG Agreement CD22SVdP, providing CDBG funding for facility improvements including the renovation of bathrooms and corridors at the SVdP CARE Center night shelter, located at 401-15th Street North, St. Petersburg, FL 33705, benefitting approximately 25,000 homeless individuals. The Agreement was effective October 1, 2022 through September 30, 2023, with the land use restriction expiring on October 1, 2035.

On July 17, 2023, the First Amendment extended the term of Agreement CD22SVdP nine (9) months to June 30, 2024, to provide additional time for plan review, permitting and procurement of services, for the completion of the project and extended the term of the Restricted Period nine (9) months to July 1, 2036, restricting the use of the property to serving homeless individuals.

Fiscal Impact:

The total amount of funding for this agreement is not to exceed $267,785.46 during the term of the Agreement. Funding for this Agreement is consistent with the County’s FY24 Adopted Budget for CDBG funds.

 

Delegated Authority:

Authority for the County Administrator to sign this Amendment is granted under Code Section 2-62 (a) (1) and Resolution No. 22-60.
