Approval and execution by the County Administrator of Change Order No.1 (final) to the agreement with Kamminga & Roodvoets, Inc. for the Mehlenbacher Road sidewalk project.

 

                     The project consisted of the construction of Americans with Disabilities Act (ADA) compliant sidewalks and curb ramps along the northside of Mehlenbacher Road, from Indian Rocks Road to the Pinellas Trail.

                     The original Contract No. 23-0209-ITB was awarded to Kamminga & Roodvoets, Inc. by the Board of County Commissioners (BCC) on March 28, 2023, in the amount of $3,575,743.50 (Granicus Item 22-2134A).

                     This change order will decrease the original agreement amount by ($237,296.34) for a revised agreement total of $3,338,447.16 and reduce the agreement term by 99 consecutive calendar days.

                     The project was substantially completed on April 18, 2024, and obtained final completion on June 28, 2024. Liquidated damages do not apply, as the County received substantial and beneficial use on April 18, 2024.

                     Final inspections of the project for all work performed under the contract were conducted by representatives of the Public Works Construction Management Division. All work has been completed in accordance with the construction contract documents.

                     Funding is budgeted under the Mehlenbacher Road Sidewalk Improvements from Palm Avenue to the Pinellas Trail Project 001976A, included in the Capital Improvement Plan, funded by the Penny for Pinellas.

Summary:

The project was substantially complete on April 18, 2024, and obtained final completion on June 28, 2024. Liquidated damages do not apply, as the county received substantial and beneficial use on April 18, 2024. Final inspections of the project for all work performed under the contract were conducted by representatives of the Public Works Construction Management Division. All work has been completed in accordance with the construction contract documents. The time between substantial and final completion accounts for the duration to complete walk thru inspection with project stakeholders, addressing punch list items, final testing, project acceptance, receipt, and approval of certified as-builts drawings, and Engineer of Record (EOR) final acceptance and approval, final project deliverables, final quantity of materials audit, resolution of claims and disputes, and receipt of final invoice.

Final quantities have been tabulated resulting in a net decrease of ($237,296.34). This is the difference between estimated and final quantities and balance of unspecified work not used.

 

Background/Explanation:

This project consisted of construction of ADA compliant sidewalks and curb ramps along the northside of Mehlenbacher Road, from Indian Rocks Road to the Pinellas Trail. The sidewalk project also necessitates drainage work within the project limits.

 

Fiscal Impact:

Funding is budgeted under the Mehlenbacher Road Sidewalk Improvements from Palm Avenue to the Pinellas Trail Project 001976A, included in the Capital Improvement Plan, funded by the Penny for Pinellas. 

 

Delegated Authority:

Authority for the County Administrator to execute this Change Order No.1 final is granted under Code Section 2-62(a)(3).
