Approval and execution by the County Administrator of Change Order No.1 (final) to the agreement with Kamminga & Roodvoets, Inc. for the 42nd Avenue North Roadway and Sidewalk Improvement project.

 

                     This contract was for the 42nd Avenue North roadway and sidewalk improvements project.

                     The original contract was awarded to Kamminga & Roodvoets, Inc by the BCC on March 28, 2023, in the amount of $4,735,766.50.

                     This change order will decrease the original agreement amount by ($57,790.26) for a revised agreement total of $4,677,976.24 and extend the agreement term by 35 consecutive calendar days.

                     The project was substantially completed on March 15, 2024, and obtained final completion on May 30, 2024. Liquidated damages do not apply, as the County received substantial and beneficial use on March 15, 2024.

                     Final inspections of the project for all work performed under the contract were conducted by representatives of the Public Works Construction Management Division. All work has been completed in accordance with the construction contract documents.

                     Funding is budgeted under the 42nd Avenue from 35th Street N to 46th Street N Drainage and Sidewalk Project 002128A, included in the Capital Improvement Plan, funded by the Penny for Pinellas and a Florida Department of Transportation (FDOT) construction grant.

 

Contract No. 23-0144-ITB-C decrease in the amount of ($57,790.26) for a final contract total in the amount of $4,677,976.24.

Summary:

The project was substantially complete on March 15, 2024, and obtained final completion on May 30, 2024. Liquidated damages do not apply, as the County received substantial and beneficial use on March 15, 2024. Final inspections of the project for all work performed under the contract were conducted by representatives of the Public Works Construction Management Division. All work has been completed in accordance with the construction contract documents. The time between substantial and final completion accounts for the duration for the contractor to submit their final video package and for the County to complete the review of the contractor's final video package submittal, punch list items, project acceptance, final project deliverables, final quantity of materials audit, resolution of claims and disputes, and receipt of final invoice.

Final quantities have been tabulated resulting in a net decrease of ($57,790.26). This is the difference between estimated and final quantities and balance of unspecified work not used.

 

Background/Explanation:

This project consisted of constructing ADA compliant sidewalk and curb ramps on both the north and south sides of 42nd Avenue N from 46th Street N to 35th Street N. The project also included the milling and resurfacing and partial reconstruction of the roadway with drainage improvements.

 

Fiscal Impact:

Funding is budgeted under the 42nd Avenue from 35th Street N to 46th Street N Drainage and Sidewalk Project 002128A, included in the Capital Improvement Plan, funded by the Penny for Pinellas and a Florida Department of Transportation (FDOT) construction grant.

 

Delegated Authority:

Authority for the County Administrator to execute this Change Order No.1 final is granted under Code Section 2-62(a)(3).
