Summary:
Summary
The subject property consists of two (2) vacant parcels totaling approximately 3.22 acres in size. The 2.73-acres northern portion of the subject site was previously occupied by a mobile home park that closed in 2008, while the 0.49-acre southern portion has never been developed. The applicant would like to develop this property with a restaurant/bar.
The subject property is designated RLM on the FLUM, which generally allows residential dwelling units as well as institutional, office, retail, recreation, and other non-residential uses with additional standards and limitations. The RLM designation allows up to 10.0 residential units per acre. Nonresidential uses are limited to a maximum floor area ratio (FAR) of 0.50 and a maximum impervious surface ratio (ISR) of 0.75.
The applicant is requesting to amend the future land use of the subject property to ROR, like property directly adjacent to the west. The ROR designation generally allows for a range of uses including residential, office, retail, and light manufacturing as well as institutional, medium manufacturing, recreation, and other ancillary nonresidential uses with additional standards and limitations. The ROR designation generally allows up to 24 residential units per acre. Nonresidential uses are limited to an FAR of 0.55 and a maximum ISR of 0.85.
The subject property is zoned both Residential Mobile/Manufactured Home (RMH) (2.73 acres) and R-4, One (1), Two (2), and Three (3) Family Residential (0.49 acre). The applicant seeks to rezone the entire property to Commercial Parkway (CP), like property directly adjacent to the west (Companion Zoning Atlas amendment Case No. ZON-25-08.) The proposed land use amendment and rezoning, in combination, will allow the subject property to be redeveloped with the intended uses.
The applicant has submitted a Development Agreement to limit the types of uses on the site. The Development Agreement contains the following development restrictions: One (1) the property shall be limited to a restaurant, bar, and other accessory uses that directly support the principal permitted use; Two (2) the property shall be developed substantially in conformance with the Conceptual Site Plan; Three (3) no amplified music shall be permitted on the property; Four (4) the observation deck shown on the Concept Plan shall be for patrons of the restaurant only and shall not be open to the public; Five (5) development standards shall be limited by the concept plan, including building size, setbacks, and buffering; Six (6) no residential uses shall be permitted; and Seven (7) any dock facilities shall comply with Florida Department of Environmental Protection (FDEP) impaired waterbody criteria for Lake Tarpon. Two (2) additional restrictions were added on August 12, 2026, at the LPA hearing: Eight (8) Removal of the existing boat ramp; and Nine (9) any boat docks are not to be located on the north side of the site. Per the conceptual site plan, the restaurant/bar building will be located on the eastern end of the property adjacent to Lake Tarpon. This location on the property puts the building the furthest distance from the surrounding residential uses.
The subject property is located approximately 400 feet east of US Highway 19 North at the eastern terminus of Timberlane Road. The property also has direct frontage on Lake Tarpon. The surrounding area contains a mix of residential and non-residential uses. To the north of the site, across an unimproved county right-of-way, is a single-family subdivision. Adjacent to the south, and taking access through the subject site, are four (4) single-family homes; and further south across a canal is a multifamily development and a large vacant conservation area. To the west is a hotel and to the east is Lake Tarpon.
The subject property has a high flood risk on the eastern half of the property. It is within the CHHA. The property lies within a Pinellas County Coastal 100-Year flood zone with a finished floor elevation (FFE) requirement of 11.3 feet. The Development Agreement will prohibit residential uses, which would remove the potential for 32 residential units (based on the FLUM) out of a flood hazard area and evacuation zone.
Given the location of the site, removal of residential from the CHHA, and proposed restrictions of the Development Agreement per the companion Zoning Atlas amendment case, staff is of the opinion that the proposed FLUM amendment will allow for the site to be redeveloped to the County’s development regulations in a more appropriate manner. Additionally, when evaluating the overall compatibility of the request with the surrounding uses in the area, the proposed use is generally compatible with the neighboring uses. Lastly, the proposal is consistent with the County Comprehensive Plan and is appropriate for this location and based on the findings of this report.
