Summary:

Summary

The subject property consists of two vacant parcels totaling approximately 3.22 acres in size.  The 2.73-acres northern portion of the subject site was previously occupied by a mobile home park that closed in 2008, while the 0.49-acre southern portion has never been developed.

The subject site is zoned RMH, Residential Mobile/Manufactured Home (2.73 acres) and R-4, One, Two, and Three Family Residential (0.49 acre).  The current RMH zoning allows for a mobile home park, and the R-4 zoning allows single-family homes, duplex, or triplex; however, either zoning does not allow commercial uses. The property is designated RLM, Residential Low Medium on the Future Land Use Map, which allows up to 10.0 residential units per acre.  The applicant wishes to develop this property with a restaurant/bar. The proposed rezoning to the CP zoning district will allow the property to be redeveloped with the intended uses. The applicant has also requested a Future Land Use Map (FLUM) amendment to R/O/R, Residential/Office/Retail via companion case FLU-25-10.

The applicant has submitted a Development Agreement to limit the types of uses on the site. The development agreement contains the following development restrictions: (1) the property shall be limited to a restaurant, bar, and other accessory uses that directly support the principal permitted use; (2) the property shall be developed substantially in conformance with the Conceptual Site Plan; (3) no amplified music shall be permitted on the property; (4) the observation deck shown on the Concept Plan shall be for patrons of the restaurant only and shall not be open to the public; (5) development standards shall be limited by the concept plan, including building size, impervious coverage, setbacks, and buffering; (6) no residential uses shall be permitted; and (7) any dock facilities shall comply with FDEP impaired waterbody criteria for Lake Tarpon. Two additional restrictions were added at the August 12, 2026, LPA hearing: (8) Removal of the existing boat ramp; (9) Any boat docks are not to be located on the north side of the site. Per the conceptual site plan, the restaurant/bar building will be located on the eastern end of the property adjacent to Lake Tarpon. This location on the property puts the building the furthest distance from any surrounding residential uses.

The subject property is located approximately 400 feet east of US Highway 19 N at the eastern terminus of Timberlane Road. The property also has direct frontage on Lake Tarpon. The surrounding area contains a mix of residential and non-residential uses. To the north of the site, across an unimproved county right-of-way, is a single-family subdivision, adjacent to the south, and taking access through the subject site, are 4 single-family homes, and further south across a canal is a multifamily development and a large vacant conservation area, to the west is a hotel, and to the east is Lake Tarpon.

The subject property has a high flood risk on the eastern half of the property. The subject property is within the Coastal High Hazard Area (CHHA). The subject property lies within a Pinellas County Coastal 100-Year flood zone with a finished floor elevation (FFE) requirement of 11.3 feet. The development agreement will prohibit residential uses, which would remove the potential for 32 residential units (based on the FLUM) out of a flood hazard area and evacuation zone.

Given the location of the site, removal of residential from the CHHA, and proposed restrictions of the development agreement, staff is of the opinion that the proposed Zoning Atlas amendment with the associated Development Agreement will allow for the site to be redeveloped to the County’s development regulations in a more appropriate manner.  Additionally, when evaluating the overall compatibility of the request with the surrounding uses in the area, the proposed use is compatible with the neighboring uses.  Lastly, the proposal is consistent with the Pinellas County Comprehensive Plan and is appropriate for this location and based on the findings of this report subject to the approval of the companion FLUM amendment case FLU-25-10.
