Recommended Action

Approval and execution by the County Administrator of the Third Amended and Restated Interlocal Agreement (ILA) with the Tampa Bay Estuary Program (TBEP) and other local agencies for funding in support of continued implementation of the Comprehensive Conservation and Management Plan (CCMP) for Tampa Bay.

•                     Local government participants contribute annually to TBEP to implement goals described in Tampa Bay CCMP.

•                     ILA sets forth County’s annual funding commitment for a five (5) year period, Fiscal Year (FY) 2027 through FY 2031.

•                     County’s contribution for FY27 is $62,612 and increases annually by 2.5%.

•                     Total funding associated with ILA is $335,347.

Funding for this Interlocal Agreement is included in the FY26 adopted and FY27 proposed budget of Public Works in the Surface Water Utility Fund. Funding for future years is dependent on approval in the annual County Operating Budget.

•                     A revised agreement was provided by TBEP with two changes requested by Tampa Bay Water. The first is a change to the attestation on their signature page. The second is a change to the definition of Tampa Bay Water. These revisions necessitated the County to re-execute the agreement.

Total County commitment is $335,347 for the period of October 1, 2026, through September 30, 2031.

Body

Strategic Priorities:

Resilient Infrastructure and Environment
1.3 Increase access to green space.
1.4 Improve environmental quality.
1.5 Strengthen resilience and adaptation.

Summary:

The purpose of this Interlocal Agreement (ILA) is to update the previously approved ILA to continue funding efforts of TBEP in cooperation with other local governments and agencies to implement the goals of Tampa Bay Comprehensive Conservation and Management Plan (CCMP). The ILA is reviewed and updated by TBEP Policy Board every five (5) years. The ILA sets forth the County’s annual funding commitment for FY  2027 through FY 2031. The County’s contribution for FY 2027 is $62,612 and increases annually by 2.5%. Total funding associated with ILA is $335,347.

Background/Explanation:

Pinellas County has partnered with TBEP since the original CCMP was adopted in 1998. The plan was updated in 2006, 2013, 2017, and most recently in 2023. Continued partnership ensures that County actively participates in discussions and plans for implementing CCMP. The annual dues for Pinellas County are reduced in this ILA as compared to the previous ILA because of updated partner contributions.

Participating agency dues are adjusted annually using one of two schedules, presented in Appendix A of the ILA. Annual dues under Schedule 1 in the ILA increase at a lower rate each year compared to Schedule 2. Schedule 1 dues apply when County contributes at least $100,000 to the Tampa Bay Estuary Restoration Fund or to a project in TBEP work plan for that year. Schedule 2 applies if County does not have any qualifying projects. Schedule 2 is applicable currently.

Fiscal Impact:

Total funding associated with this ILA is $335,347.

County’s annual dues are specified in Appendix A Schedule 2 of the ILA, excerpted below:
