Background/Explanation:
The Florida Legislature created the VCTC to encourage voluntary cleanup of certain contaminated sites and brownfield sites. Participants may be private or public entities, but they must meet the eligibility criteria established in Florida Statutes and they must enter into either a Voluntary Cleanup Agreement or a Brownfield Site Rehabilitation Agreement.
Tax credit certificates are awarded by the Florida Department of Environmental Protection from an annual authorization and are valid against Florida Corporate Income Tax.
The County executed a Brownfield Site Rehabilitation Agreement with FDEP on December 30th, 2024, for the former Dansville Central Landfill; December 28th, 2015, for the former 126th Avenue North Landfill; December 13th, 2016, for the former Zero Corporation site; and on August 2nd, 2021, for the former Baypointe Golf Course. This allows the County to apply for tax credits for site rehabilitation activities. The County is now applying for site rehabilitation tax credit for total site rehabilitation costs incurred for the four (4) Brownfield sites during the 2025 calendar year.
Fiscal Impact:
Anticipated revenue is $120,552.49. The corporate tax credits are auctioned on the open market. Corporations who have a Florida Corporate tax liability typically purchase the certificates and the anticipated County proceeds are reduced by approximately 10% due to broker fees as reflected in total above.
Revenue from the sale of the tax credits is not included in the FY26 budget but may be recognized later through a budget amendment. Revenue will be recorded in the funds in which the Brownfield sites cleanup and redevelopment expenditures were recorded.
Delegated Authority:
Authority for the County Administrator to sign this VCTC application is granted under Code Section 2-62(a)(1).
