Approval and execution by the County Administrator of the Operating Agreement (Agreement) between Pinellas County, Florida and Florida Botanical Gardens Foundation, Inc. (Foundation) for continued support at the Florida Botanical Gardens (the Gardens).
- The Foundation is a nonprofit citizen support organization.
- The Foundation provides significant volunteer hours, monetary funds, and educational programming in support of the Gardens.
- Operating agreement provides a legal mechanism for the Foundation to provide these services.

Summary:
Approval and execution of this Agreement will establish an updated and current Operating Agreement between the County and the Foundation. The Agreement with Foundation is required under County Code, Chapter 90, Sec. 90-18.
Background/Explanation:
The Foundation is a nonprofit volunteer group that works in partnership with the County to enhance the Garden’s ecosystem, infrastructure, and visitor experience. This Agreement is updated every five (5) years and provides a basic legal mechanism for the County and the Foundation to support The Florida Botanical Gardens. The County has had a relationship with the Foundation since 2003.
Fiscal Impact:
Revenue funding for this Agreement is included in the current-year budget of Parks and Conservation Resources in the General Fund. The Foundation will provide a minimum of $60,000 in funding per fiscal year to supplement maintenance of the gardens.
Delegated Authority:
Authority for the County Administrator to sign this Agreement is granted under (Code Section 2-62 (a)(1).
