Approval and execution by the County Administrator of the grant award acceptance for the Fiscal Year 2024 State Criminal Alien Assistance Program.

•                     The State Criminal Alien Assistance Program (SCAAP) provides federal grant funding to units of local government that incur certain types of costs due to incarceration of undocumented criminal aliens.

•                     Annual SCAAP formula grant awards are calculated from information provided in applications, information provided to OJP by the Department of Homeland Security regarding review of data on eligible inmates, and the amount of appropriated funds available for the SCAAP application cycle.

•                     The 2024 SCAAP grant award provides one-time funding in the amount of $101,966.00, to be used for correctional purposes only. No match is required.

•                     The Pinellas County Sheriff’s Office will handle the financial and programmatic administration of this grant award, utilizing funds for overtime costs.

•                     There are no programmatic or fiscal reporting requirements.

•                     Funding for this grant was anticipated and included in the FY25 Adopted Budget.

•                     Delegate the authority to the department to complete the acceptance online. The completion of checked boxes constitutes the County Administrator’s execution.

Summary:

A state or unit of local government is eligible to apply for a payment under the FY 2024 State Criminal Alien Assistance Program if it incarcerated individuals in a correctional facility during the period of July 1, 2022 through June 30, 2023 whom it either (1) knows were undocumented criminal aliens or (2) reasonably and in good faith believes were undocumented criminal aliens.

Background/Explanation:

The OJP administers SCAAP in conjunction with the Bureau of Immigration and Customs Enforcement (ICE) and Citizenship and Immigration Services, Department of Homeland Security (DHS). SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens with at least one felony or two misdemeanor convictions for violations of state or local law and incarcerated for at least 4 consecutive days during the reporting period. SCAAP Grant benefits the County by offsetting a portion of correctional costs. At the time of the award, the Sheriff provides a specific area within jail operations where the money may be spent. It must be used for correctional purposes only. There is no programmatic or fiscal reporting on this grant.

Fiscal Impact:

The federal award amount of $101,966.00 must be used for correctional purposes only. PCSO is serving as the fiscal agent for grant administration and will utilize funds for overtime costs. No match is required.

Delegated Authority:

Authority for the County Administrator to sign this Award Acceptance is granted under Code Sections 2-62 (a)(1) and 2-62(a)(4).
