Summary:

This Joint Project Agreement (JPA) provides the mechanism for the County to complete FDOT’s trail reconstruction within the Duke Energy corridor and provides the mechanism for FDOT to reimburse the County for their portion of project costs.

Work associated with the JPA includes removal of the existing trail north and south of SR 60 and reconstructing to FDOT design plans, within the Duke Energy corridor. Work will commence by April 14, 2025, and be completed by July 30, 2025.  Work within the FDOT right-of-way will be completed by FDOT’s contractor.

Background/Explanation:

The 2020 Forward Pinellas Active Transportation Plan included the top ten trail overpass locations to create safe crossings along the Pinellas Trail Loop where it intersects with major multi-lane roadways.  The Duke Energy Trail crossing of SR 60 was ranked first on the list.  However, the transmission lines located within the Duke Energy corridor prevents any raised structure including a trail overpass.

FDOT researched and designed safety features to be constructed instead of a trail overpass.  These features include realigning the Duke Energy crossing slightly to the east of its current location.

Section 14 of the Agreement requires the County to indemnify and hold harmless the FDOT to the extent permitted by law as limited by and pursuant to the provisions of Section 768.28, Florida Statutes.  County Resolution No. 06-70 prohibits the County from indemnifying others under most circumstances.  FDOT will not modify the indemnification section of this agreement as this is a standard requirement in their agreements.

Fiscal Impact:

The cost for FDOT’s work within the Duke Energy corridor is $76,468.00.  Funding for payment of the material costs is provided by the Transportation Trust Fund. The FDOT will reimburse the County when the project is complete. The reimbursement will be back to the Transportation Trust Fund.

Delegated Authority:

Authority for the County Administrator to sign this Joint Participation Agreement is granted under (Code Section 2-62 (A)(1).
