Body

Strategic Plan:

Practice Superior Environmental Stewardship
3.2 Preserve and manage environmental lands, beaches, parks and historical assets.

Summary:

The Project was previously a SWFWMD Florida Department of Transportation mitigation funded project.  The County was the lead on the design and permitting phase which was completed.  Due to procedural changes at SWFWMD, the project is moving into a Surface Water Improvement and Management (SWIM) project. SWFWMD will take the lead and pay directly for the construction costs, with funding also being provided through the Tampa Bay Environmental Restoration Fund.

Background/Explanation:

As of November 27, 2018, the SWFWMD and the County entered into Agreement No. 13CS0000005-R (Original Agreement) combining their resources and efforts for a coastal habitat restoration project within the Mobbly Bayou Preserve. The SWFWMD and the County desire to terminate the Original Agreement and incorporate certain provisions from the terminated agreement into a new agreement that will continue their cooperative commitment to a coastal habitat restoration project within the Preserve Management Area of the Mobbly Bayou Preserve subject to their revised understanding.

Fiscal Impact:

No new budgetary impacts anticipated. As stated in the Cooperative Agreement (No. 13CS0000005-R2) Between the Southwest Florida Water Management District and Pinellas County for Mobbly Bayou Habitat Restoration Projects (W353) (Page 3, Section 4), the SWFWMD shall be responsible for all actual Project costs up to the Maximum Amount (anticipated to not exceed $1,100,000) contingent upon the SWFWMD’s Governing Board appropriating funds in its approved budget for the Project in each Fiscal Year of this Agreement.  After project completion, associated operation and maintenance costs (Page 3, Section 6) incurred by the County (which includes the control of category 1 and category 2 invasive species) are covered under normal operations via the Tree Bank Fund as part of PCR’s routine resource management activities.

Delegated Authority:

Authority for the County Administrator to sign this Cooperative Agreement is granted under Code Section 2-62 (a)(1).
