This third amendment increases the agreement not to exceed contract cap by $25,000.00 for a revised not to exceed contract cap amount of $125,000.00 for additional legal services in connection with litigation related to the County’s allocation and administration of funds received from the American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Fund (SLFRF).

Fiscal Impact:
The proposed third amendment will increase the not-to-exceed cap of the agreement by $25,000.00, raising the not-to-exceed cap to $125,000.00. The original agreement, first amendment and second amendment to the agreement was approved by the Purchasing Director within their delegated authority. This third amendment exceeds the delegated authority of the Purchasing Director; therefore, the County Administrator is requested to approve the third amendment.
