Recommended Action:

Recommended Action

Approval and execution by the County Administrator of the Amendment to the Petroleum Cleanup Participation Program (PCPP) Agreement (Agreement) with the Florida Department of Environmental Protection (FDEP) for the Clearwater Department of Health Facility at 310 N. Myrtle Avenue, Clearwater.

1.) Execution of Amendment allows an FDEP-approved contractor to complete petroleum discharge cleanup and updated closure activities to the Site Rehabilitation Strategy which will increase total cleanup costs at County-owned Clearwater Department of Health Facility.

2) The updated closure activities are important because they will result in achieving “No Further Action” status, so there will be no future costs for monitoring activities.

2.) FDEP estimates cleanup and closure costs will be additional $116,380 (including 10% contingency).  FDEP is responsible for 75% of cost up to $87,285 and the County is responsible for the remaining 25% up to $29,095.

3.) Funding for amendment included in the FY25 Adopted Budget of the Stormwater and Vegetation Planning and Engineering Division of the Public Works Department in the General Fund.

Summary:

Execution of the Amendment to the Agreement will continue to allow an FDEP-approved contractor to conduct assessment and petroleum discharge cleanup activities at the Clearwater Department of Health Facility which is owned by the County.  These activities are expected to result in a no further action designation from FDEP.

Background/Explanation:

A petroleum discharge was filed with FDEP in 1991.  In February 2017, an FDEP contractor completed a Low-Score Assessment at this location and recommended that the site await PCPP funding for additional assessment and cleanup in priority order.  The site became eligible for PCPP funding in 2018 and a PCPP Agreement was fully executed in May of 2018.

This is a voluntary program.  However, if the County does not take advantage of this program funding now, FDEP will require the County to be responsible for the total cost of cleanup.

Fiscal Impact:

FDEP estimates the site assessment and cleanup costs will be an additional $116,380 (including 10% contingency).  FDEP is responsible for 75% of the cost up to $87,285 and the County is responsible for the remaining 25% up to $29,095.

This expense will be paid from the existing FY 25 Capital Improvements Division Operating Budget, FDEP Petroleum Cleanup Participation Program PID 004078A.

Delegated Authority:

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62(a)(1).
