Recommended Action:

Recommended Action

Approval and execution by the County Administrator of the Cooperative Interlocal Agreement with the City of St. Petersburg for limited, as needed, and emergency basis shared use of specialized equipment and/or support services.

•                     Agreement intent is shared use of specialized equipment between County and municipal partners.

•                     Agreement was recommended by the County Wastewater/Stormwater Technical Working Group in 2018 as a method of promoting improved efficiencies and potential cost saving among participants and for taxpayers.

•                     Similar to the Federal Emergency Management Agency debris removal contracts, this interlocal agreement will not be utilized unless there is an emergency event. Actual expenditure is contingent based upon services required during an emergency event. The Department will not obligate the County without identifying that amount of funding within each fiscal year’s existing budget.

•                     Utilities has not budgeted for this Agreement in the Fiscal Year (FY) 2024 Adopted Budget because this contract is for as needed/emergency purposes. This Agreement needs to be in place in case of emergencies as the process to approve would be too lengthy to respond to an immediate issue. Should Utilities need to use this agreement, revenue would be unanticipated, and expenditures would need to be absorbed by lapse, spending adjusted, or a budget amendment sought. Associated revenue and expenditures will be derived from the Sewer Operating and Revenue Fund.

Expenditures and reimbursements pursuant to the Agreement shall not exceed $250,000.00 within the FY, per municipality.  Agreement is for ten (10) years.Body

Strategic Plan:

Deliver First Class Services to the Public and Our Customers
5.1 Maximize partner relationships and public outreach
5.2 Be responsible stewards of the public’s resources
5.3 Ensure effective and efficient delivery of county services and support
5.4 Strive to exceed customer expectations

Summary:

Based upon recommendation of the County Wastewater/Stormwater Technical Working Group, the Agreement provides sharing specialized equipment with local municipalities to ensure back-up, provide secondary support on large projects, and generally provide an option to ensure efficient and effective operations. The Agreement creates a system for the occasional sharing of specialized motor vehicles, equipment, and machinery for efficiency and effectiveness of operations on as needed basis, as well as for use in emergency situations.  The County and municipalities agree to make available to each other equipment, as well as trained personnel to operate the equipment.  No equipment shall be provided without an operator supplied by the provider.

The Agreement shall commence upon execution and continue for a period of ten (10) years.  The Agreement may be renewed subject to execution of a written renewal agreement between the County and municipalities. Each renewal period may not exceed ten (10) years. There is no limit to the number of renewals unless so specified in a subsequent renewal agreement.

Background/Explanation:

It is not cost effective or financially feasible for each municipality to individually purchase certain special-use vehicles or equipment. This Agreement has the potential to achieve savings and improve efficiencies between the County and municipal partners through economies of scale, as well the opportunity to work together to maximize existing resources.  The Agreement requires each party assume liability for the negligence of its officers and employees for and indemnify and hold harmless the other party.

Interested municipalities will be provided a copy of this Agreement for their consideration and Approval by October 1st each FY. Signed Agreements returned by that date will be submitted collectively for approval by the Board of County Commission, or the appropriate delegated authority based on level of participation.

Fiscal Impact:

Expenditures or reimbursements received for shared use of equipment are not anticipated to exceed $250,000.00 per municipality.  Should individual agreements exceed an amount of $250,000.00.00 in a fiscal year, Board of County Commissioners approval of an amendment to the Agreement will be required.

Utilities has not budgeted for this agreement in the FY 2024 Adopted Budget because this contract is for as needed/emergency purposes.

Delegated Authority:

Authority for the County Administrator to approve this Agreement is granted under Code Section 2-62 (a)(1).
