Recommended Action:

Recommended Action

Approval of the Sovereignty Submerged Lands Easement with the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (BTIITF) for the Living Shoreline Project at Philippe Park (Project).

 

                     Easement is for that portion of State-owned land within Philippe Park adjacent to the County-owned lands for continuity of future phases of the Project.

                     The Living Shoreline Project is fully designed and permitted.  The first phase is located on the southernmost point of the Park in a County-owned area.

                     This Easement is required to allow the Project to proceed on State lands.

                     Companion item to Boundary Line Agreement, approved by the Director of Administrative Services through Legistar file 21-1043D.

                     Prior signature by the Chair of the Board of County Commissioners obtained through Legistar file 21-024C to meet the required deadline.

 

County PID No. 004178B Philippe Park Shoreline; executed easement to be recorded by Florida Department of Environmental Protection, as agent for and on behalf of the BTIITF and provided to County; no funding required.

The Easement allows the County to install living shoreline elements on the Sovereign Submerged Land at Philippe Park, as designed and permitted for the Project. An Easement is required when a Project includes State lands within a project area.

Background Information:

The County has completed design and received applicable permits to construct and maintain a shoreline stabilization Project by installing salt marsh grasses, low-profile oyster habitat breakwaters, and riprap breakwaters along and just offshore of Philippe Park. This living shoreline project will occur in several phases.  The first phase located at the southernmost point of the Park in a County-owned area. Future areas located within the more northern areas of the Park have no clear title and thus are considered State lands which requires the County to obtain State approval, through this Easement to complete the project in those locations.
