Summary
The national trend for the settlement of litigation arising from the opioid epidemic includes settlement with the states’ attorneys general for and on behalf of all local governments within the state. Pinellas County and three of its municipalities, Clearwater, Pinellas Park and St. Petersburg, are litigating plaintiffs in the National Prescription Opiate Litigation, MDL No. 2804 (N.D. Ohio), while the State is the litigating plaintiff in Circuit Court in Pasco County. The Florida Attorney General has proposed a Memorandum of Understanding (the Florida Plan) that governs the allocation and use of settlement proceeds and would enable the Attorney General to negotiate on behalf of all participants. The Florida Plan allows for certain counties to receive a portion of regional settlement funds if they meet the requirements of a “Qualified County” as defined by the Florida Plan. Two such requirements to be a Qualified County are involvement in an Opioid Taskforce and the adoption or existence of an Abatement Plan. The proposed resolution satisfies these two requirements by outlining Pinellas County’s membership in the Pinellas County Opioid Task Force and adopting the Pinellas County Opioid Task Force’s Strategic Plan.
