Approval of the ranking of firms and execution of the agreements with Curaparr, Inc. d/b/a Center for Rational Living (Center for Rational Living) and WestCare Gulfcoast Florida, Inc. (WestCare) for Adult Drug Court Treatment.

 

                     These agreements provide voluntary services for non-violent felony drug offenders within in accordance with Chapter 65D-30, Florida Administrative Code, known as the Substance Abuse Standards.

                     This contract provides Residential Treatment Services, Outpatient services, Behavioral Health Screening Assessments and Transitional Housing to individuals within two divisions of Adult Drug Court (Division N and Division Z)

                     Funding for Division Z is State funded and diverts prison-bound offenders into drug treatment and mentoring instead of confinement.

                     Funding for Division N is derived from the General Fund and diverts first time offenders allowing for a dismissal of charges or reduced probation.

                     Three proposals were received with Center for Rational Living and WestCare ranked as the highest-ranking firms and recommended for award.

                     Center for Rational Living was awarded $1,173,350.00.00 and Westcare $4,951,650.00 for a total awarded amount of $6,125,000.00

                     There is no increase to the overall drug court budget for FY23.

 

Contract No. 22-0371-P(LN); in the not-to-exceed amount of $6,125,000.00 effective October 1, 2022 through September 30, 2027; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary

The purpose of this contract is to provide voluntary services for non-violent felony drug offenders in accordance with Chapter 65D-30, Florida Administrative Code, known as the Substance Abuse Standards. The treatment-based approach exists to offer an opportunity to offenders to avoid prison and become productive and drug free members of the community.

Background Information:

An RFP was released on April 14, 2022, resulting in three (3) responsive submittals. Both WestCare and the Center for Rational Living were selected as the highest-ranking firms with negotiations centering around several factors, including approach and cost. The firms in order of ranking are attached on the ranking spreadsheet.  The contract has a term of sixty (60) months beginning October 1, 2022.

The Sixth Judicial Circuit (Court) Adult Drug Court (ADC) program originally operated as an eighteen (18) to twenty-four (24) month, Court-supervised comprehensive treatment for non-violent felony offenders participating the ADC program, known as Division N. In 2001, the ADC was expanded to serve otherwise prison-bound defendants (those scoring prison time), known as Division Z.  Both Division N and Z are operated by the Sixth Judicial Circuit serving Pinellas County.

The ADC is a voluntary program involving regular court appearances before a Drug Court judge.  The Court exists to provide Drug Court participants the opportunity to avoid a prison sentence by becoming productive, drug-free members of the community.  The treatment-based approach begins with an eligible defendant receiving a substance abuse assessment administered by a licensed treatment provider.  Following the substance abuse evaluation and based upon the result, the licensed and certified assessor will make a treatment recommendation to the Court.

Frequent judicial review hearings enable the Court to closely monitor a participant’s progress in treatment and results of frequent random drug testing.  Participants report directly to the Drug Court judge at these hearings, and based upon success or setbacks, the Drug Court judge either rewards compliance or sanctions non-compliance.

 

Fiscal Impact:

The agreement has a term of sixty (60) months.

 

Estimated annual expenditure is $1,225,000.00 for a sixty-month total of $6,125,000.00.

 

FY23 Budgeted $715,000.00 to Div N (Westcare)

FY23 Budgeted $599,930.00 to Div Z (Center for Rational Living) Project number 003909C

 

Funding for Division Z is derived from State appropriated dollars and Division N is derived from the Human Services General Fund Operating Budget.
