Summary
This policy establishes guidelines for the County Attorney’s Office when providing legal representation of multiple County Attorney clients, including notification to the Board of County Commissioners (BCC), Constitutional Officers, and other County Attorney clients, consistent with the requirements and standards of the Rules of Professional Conduct, applicable Florida Statutes, County policies, and the County’s Risk Management Self-Insurance Program. The policy was originally developed by the County Attorney’s Office, with input and review from outside counsel, and approved by the BCC on March 18, 2008. Management with the County Attorney’s Office recently reviewed this policy to ensure it remains consistent with applicable Florida Bar Rules and Florida Statutes. The proposed changes are largely non-substantive in nature and are recommended to make the document more readable and user-friendly.
Consistent with Section 4.02(a) of the Pinellas County Charter, which provides that “the office of the county attorney…shall be responsible directly to the board of county commissioners,” this policy is being brought to you for approval. Once approved, the revised policy will be distributed to all Constitutional Officers and updated letters recognizing the common representation undertaken by the County Attorney’s Office will be drafted and provided to the various clients.
